1. RESERVE MY CAR SERVICE TERMS
(a) Nissan Motor Co. (Australia) Pty Ltd (ACN 004 663 156) (“Nissan”), through its website at www.nissan.com.au (“Website”), provides the ability for you to offer to buy selected Nissan vehicles by customising the vehicle and paying a reservation fee (“Reserve My Car Service”). The Reserve My Car Service does not give you the right to have a particular vehicle reserved or held for you.
(b) The following terms and conditions (as amended from time to time) (“these Terms”) apply to the Reserve My Car Service: (i) any terms specified on the Reserve My Car Service Website page(s) relating to a selected Nissan vehicle; and (ii) These Nissan ‘Reserve My Car’ Terms and Conditions.
(c) Please read these Terms carefully before using the Reserve My Car Service. By using the Reserve My Car Service, you agree to be bound by these Terms.
(d) Nissan reserves the right to make changes to any version of these Terms at any time by posting the changes on the Website. You will be subject to the Terms made available on the Website at the time that you use the Reserve My Car Service. You may at any time cease using the Reserve My Car Service and/or (subject to clause 5) request a refund of any reservation fee(s) paid, including in the event of any such change.

2. RESERVE MY CAR PROCESS
(a) By using the Reserve My Car Service, you can offer to purchase selected Nissan vehicles from a participating dealer by: (i) selecting the vehicle that you intend to purchase by selecting a model variant, options and colours (“the Vehicle”); (ii) nominating the preferred participating Nissan dealer from which you wish to purchase your Vehicle (“your Nominated Dealer”); (iii) completing the “Reserve Now” or "Reserve My Car" online form on the Website and providing your contact details; and (iv) paying a fully refundable reservation fee (“Reservation Fee”) to Nissan via the online third party gateway.
(b) Once you pay the Reservation Fee, Nissan will: (i) send you an email confirming payment and the details of your Nominated Dealer; (ii) send your contact details and Vehicle information to your Nominated Dealer; and (iii) transfer the Reservation Fee to your Nominated Dealer.
(c) By using the Reserve My Car Service, you confirm that you invite your Nominated Dealer to contact you for the purposes of discussing and negotiating a potential purchase of the Vehicle or an alternative vehicle, and consent to them contacting you for this purpose at or on any address or telephone number you provided in the "Reserve Now” or “Reserve My Car” online form on the Website.

3. ELIGIBILITY
(a) To use the Reserve My Car Service, you must: (i) be over the age of 18; (ii) be an Australian resident living in Australia; (iii) not be a third party reseller of Vehicles; and (iv) have a legitimate interest in purchasing the Vehicle.
(b) The Reserve My Car Service is limited to one Vehicle per person, per household or business address, within any 7 day period. Multiple reservations are not permitted, and may be rejected or cancelled at Nissan or your Nominated Dealer’s reasonable discretion.

4. RESERVATION FEE
(a) The Reservation Fee for the Vehicle will be the amount outlined on the Vehicle order summary screen of the Website prior to payment.
(b) By paying the Reservation Fee, you are making an offer to purchase the Vehicle from your Nominated Dealer. You may revoke your offer at any time prior to you entering into a written sale contract to purchase the Vehicle ("Sale Contract").
(c) Payment of the Reservation Fee does not: (i) guarantee or secure ownership of the Vehicle; (ii) constitute entry into a Sale Contract with Nissan or your Nominated Dealer; or (iii) oblige you to proceed with the purchase of the Vehicle prior to signing a Sale Contract.
(d) The Reservation Fee is not a deposit on the purchase price for the Vehicle. A deposit for the vehicle may be agreed with your Nominated Dealer at the time of purchasing the Vehicle.
(e) You may be entitled to transfer the Reservation Fee to another vehicle prior to entering a Sale Contract. This will be at the discretion of your Nominated Dealer.
(f) The Reservation Fee will be processed securely via a third party platform provider (“Stripe”). You will be redirected to Stripe’s platform from the Website prior to inserting your credit card details (“Stripe Payment Page”). Nissan does not store your credit card details. Payments made via Stripe are subject to Stripe terms and conditions available on the Stripe Payment Page at the time of payment.
(g) Once payment has been processed, you will be redirected back to a confirmation page on the Website outlining the details of your payment and your Nominated Dealer.
(h) The Reservation Fee is collected by Nissan and paid to your Nominated Dealer via STRIPE, and cannot be transferred or assigned to another Nissan dealership. If you wish to change your Nominated Dealer, you will need to: (i) seek a refund of the Reservation Fee from your Nominated Dealer in accordance with clause 5; (ii) resubmit your Vehicle and Nominated Dealer selections through the Reserve My Car Service; and (iii) pay a new Reservation Fee.

5. CANCELLATION AND REFUND OF RESERVATION FEE
(a) Subject to applicable law, the Reservation Fee is fully refundable prior to you entering a Sale Contract.
(b) You must contact your Nominated Dealer to arrange for a refund of the Reservation Fee prior to entering a Sale Contract. Your Nominated Dealer must process the requested refund via STRIPE. You should expect to receive the funds within 5-10 business days of the refund being processed.
(c) You will not receive any interest on any Reservation Fee.
(d) Refunds of the Reservation Fee can only be made via the original payment method used.
(e) Subject to applicable law, Nissan or your Nominated Dealer may at any time (acting reasonably) cancel and refund the Reservation Fee to you.

6. NISSAN AUSTRALIA'S ROLE
(a) Nissan is not selling the Vehicle to you, and, outside the collection and transfer of the Reservation Fee in accordance with clauses 2(b) and 4(h) of these Terms, is not a party to your interactions with your Nominated Dealer, nor any transactions between you and your Nominated Dealer in connection with the purchase of the Vehicle. However Nissan will ensure that your Nominated Dealer refunds or applies your Reservation Fee as required in accordance with these Terms.
(b) Nissan does not warrant the accuracy of any representations made, or information provided, by your Nominated Dealer in relation to the Vehicle or any other product or service.

7. PURCHASE OF VEHICLE FROM YOUR NOMINATED DEALER
(a) Your Nominated Dealer will contact you to discuss purchasing the Vehicle.
(b) Purchase of the Vehicle is subject to availability and delivery timeframes. If the Vehicle is not available, you will be entitled to a full refund of the Reservation Fee in accordance with clause 5 of these Terms.
(c) If the Vehicle is available, terms of sale must be reached and a Sale Contract entered into between you and your Nominated Dealer.
(d) Once you sign a Sale Contract, (i) you will be required to pay your Nominated Dealer any deposit and Vehicle purchase price agreed between you and your Nominated Dealer, in accordance with the terms of the Sale Contract. (ii) At the discretion of your Nominated Dealer, the Reservation Fee: (1) may be applied towards the agreed deposit and purchase price for the Vehicle; or (2) fully refunded to you via the original payment method used.
(e) Your Nominated Dealer will be responsible for delivering the Vehicle to you in accordance with the Sale Contract and any applicable law.

8. PRICE FOR VEHICLE
Any price for the Vehicle published on the Website is a recommended retail price ("RRP") only. You will not be required to purchase, and your Nominated Dealer will not be required to sell you, the Vehicle at the RRP. If you proceed to purchase the Vehicle, the actual price payable will be that agreed by you and your Nominated Dealer.

9. DELIVERY TIMEFRAMES
Vehicle delivery times vary based on complexity and demand for the Vehicle. Typically, delivery times can vary from 1 week and up to 6 months in some circumstances. Delivery is subject to global supply chain disruptions and occasional stock shortages across the car industry, which may result in wait times being extended. Your Nominated Dealer will be able to provide you with up-to-date advice and discuss delivery options with you.

10. PRIVACY
(a) Nissan collects the personal information you provide on the Website to provide the Reserve My Car Service, and may, for this purpose and for the purpose of processing your Reservation Fee for the Vehicle, disclose such information to third parties, including but not limited to agents, contractors, service providers, and our authorised Nissan dealers.
(b) Where you have consented on the Website to receiving direct marketing communications from Nissan, Nissan may use the information you have provided to send you marketing communications.
(c) For full details of how Nissan may use and disclose your personal information, see Nissan’s Privacy Policy at https://www.nissan.com.au/privacy.html.
(d) Your Nominated Dealer is responsible for handling your personal information in accordance with their privacy policy and the Privacy Act 1988 (Cth). Please contact your Nominated Dealer if you have any queries relating to their management of your personal information.
Please contact Stripe in relation to any privacy queries relating to Stripe’s handling of your personal information.

11. GENERAL
(a) By using the Reserve My Car Service, you represent and warrant that all information submitted via the Reserve My Car Service is correct. Should Nissan or your Nominated Dealer become aware that any of the information provided by you is inaccurate or false, Nissan (acting reasonably) reserves its right to cease to offer you its Reserve My Car Service, and any reservations submitted by you may be rejected or cancelled by Nissan or your Nominated Dealer prior to entering a Sale Contract.
(b) These Terms form the entire agreement between you and Nissan in respect of the Reserve My Car Service, the Reservation Fee, and your offer to buy the Vehicle from your Nominated Dealer.
(c) Any concerns relating to the Reserve My Car Service can be sent to Nissan Australia via email at reservation@nissan.com.au . Any concerns relating to the purchase of the Vehicle can be directed to your Nominated Dealer.
(d) You must not use the Reserve My Car Service for activities that violate any applicable laws or allows others to violate applicable laws.
(e) To the full extent permitted by law, Nissan excludes all liability for any loss (including any damage, claim, injury, cost or expense, including loss of opportunity) which you may suffer or incur in connection with the Reserve My Car Service, including but not limited to any technical difficulties or access issues with the Website outside Nissan’s control. To the extent Nissan is unable to exclude any liability under or in connection with these Terms, Nissan’s maximum liability for all loss, damage, liability and/or expenses suffered or incurred by you in connection with these Terms is limited to the amount of the Reservation Fee.
(f) Nissan reserves the right at any time to cancel or remove the Reserve My Car Service from the Website (to the full extent permitted by law). If you have already paid the Reservation Fee, you will be entitled to a refund.
(g) Any provision of these Terms which is invalid or unenforceable is to be read down, if possible, so as to be valid and enforceable, and, if that is not possible, the provision will, to the extent that it is capable, be severed to the extent of the invalidity or unenforceability, without affecting the remaining terms.
(h) These Terms are governed by the laws of Victoria and the parties submit to the non-exclusive jurisdiction of those courts.
